Terms of Service

These Terms of Service ("Terms") govern your use of clipmix.net (the "Service"), operated by ClipMix ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree, do not use the Service.

This document is provided for informational purposes and is not legal advice. We recommend reviewing it with qualified counsel before relying on it.

Eligibility

You must be at least 13 years old to use the Service. EU users must be at least 16 (or the applicable age of digital consent in their country). By using the Service, you represent that you meet these requirements.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You may delete your account at any time by emailing [email protected] from the address associated with your account.

User content and licenses

The Service lets you submit Twitch clip URLs and combine them into mixes ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display it solely for the purpose of operating and providing the Service.

You represent and warrant that you have all necessary rights, licenses, and permissions to submit your User Content and that doing so does not violate any third-party rights or applicable law.

Twitch content

The Service relies on publicly accessible Twitch clip URLs you provide. You are solely responsible for complying with Twitch's Terms of Service and the rights of the original streamers and clip creators. We do not host the original Twitch clips; we generate derivative mix files from them at your request.

Acceptable use

You agree not to:

  • Submit content that infringes any copyright, trademark, or other intellectual property right.
  • Submit content that is unlawful, defamatory, obscene, harassing, or otherwise objectionable.
  • Use the Service to harass, threaten, or harm any person or group.
  • Attempt to interfere with, disrupt, overload, or compromise the Service or its infrastructure.
  • Bypass rate limits, abuse signup mechanisms, or use automated tools to access the Service without our written permission.
  • Reverse engineer, scrape, or copy the Service except as permitted by law.
  • Resell, sublicense, or commercially exploit the Service or its output without our written permission.

DMCA / copyright complaints

We respect intellectual property rights and respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA").

To submit a takedown notice, send the following to [email protected]:

  • Your physical or electronic signature.
  • Identification of the copyrighted work claimed to have been infringed.
  • The exact URL on clipmix.net where the allegedly infringing material is located.
  • Your contact information (name, address, telephone, email).
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Send all DMCA notices and counter-notices to [email protected]. If we remove material in response to a notice, the user who posted it may submit a counter-notice containing the elements required by 17 U.S.C. § 512(g)(3). We may terminate accounts of repeat infringers.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnity, and limitations of liability) will survive.

Intellectual property

The Service itself, including its software, design, and trademarks, is owned by ClipMix and its licensors and is protected by intellectual property laws. Nothing in these Terms transfers ownership of the Service to you.

Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or course of dealing. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by applicable law, ClipMix and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses arising out of or relating to your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service will not exceed one hundred US dollars ($100). Some jurisdictions do not allow these limitations; in those cases, our liability is limited to the greatest extent permitted by law.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ClipMix and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

Governing law and venue

These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. You agree to the jurisdiction of the federal and state courts of the United States for any dispute arising out of these Terms or the Service.

Changes

We may update these Terms from time to time. We will post the revised version here and update the "Last updated" date. For material changes, we will provide at least 30 days' notice through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.

Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms constitute the entire agreement between you and ClipMix regarding the Service.
